Account Registration and Security

To use certain features of our Services, you may need to have a Discord account and authorize our bot in your Discord server. You are responsible for:

  • Maintaining the confidentiality of your Discord account credentials
  • All activities that occur under your account
  • Ensuring that all users in your Discord server who interact with our bot comply with these Terms

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We reserve the right to disable your access to our Services at any time if, in our reasonable opinion, you have failed to comply with any provision of these Terms.

Use of Services

Permitted Use

You may use our Services for personal, non-commercial purposes or as explicitly authorized by Track Parlay. Our Services provide sports data tracking, parlay creation, and related features for entertainment purposes.

Prohibited Use

You agree not to use our Services:

  • In any way that violates any applicable laws or regulations
  • To engage in real-money gambling or sports betting
  • To exploit, harm, or attempt to exploit or harm minors
  • To transmit or facilitate the transmission of any harmful or malicious code
  • To interfere with, disrupt, or create an undue burden on our Services
  • To engage in any data mining, scraping, or extraction activities
  • To impersonate or misrepresent your affiliation with any person or entity
  • To infringe upon the intellectual property rights of others

Content Guidelines

Discord Integration

Our Services operate primarily as a Discord bot. By using our Services, you acknowledge and agree that:

  • You will comply with Discord's Terms of Service and Community Guidelines
  • We may access and store certain Discord data as described in our Privacy Policy
  • You grant us permission to post messages, content, and notifications in your Discord server based on your interactions with our bot
  • We are not responsible for any actions taken by Discord that may affect the functionality of our Services

The Services and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Track Parlay, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Services or our content. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our material, except as follows:

  • Your computer may temporarily store copies of materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution

Subscription and Payment

We offer free and premium subscription plans for our Services. By subscribing to a premium plan, you agree to the following:

  • You will provide accurate and complete payment information
  • You authorize us to charge your chosen payment method for the subscription fees
  • For recurring subscriptions, you authorize us to charge your payment method on a recurring basis until you cancel
  • Subscription fees are non-refundable except as expressly stated in our refund policy or as required by applicable law
  • We reserve the right to change subscription prices upon notice to you

If you wish to cancel your subscription, you may do so through the designated methods provided in our Services. Cancellation will take effect at the end of your current billing cycle.

Our Services may display sports data and statistics provided by third-party data providers. We do not guarantee the accuracy, completeness, or timeliness of this data. You acknowledge that such information may contain errors or inaccuracies, and you agree not to make any significant decisions based solely on this information.

Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TRACK PARLAY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TRACK PARLAY MAKES NO WARRANTY THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRACK PARLAY, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES.

IN NO EVENT SHALL TRACK PARLAY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless Track Parlay, its affiliates, and their respective directors, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account or remove our bot from your Discord server, you may do so at any time. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved exclusively through final and binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the English language and the arbitral decision may be enforced in any court.

Any legal action or proceeding relating to your access to, or use of, the Services or these Terms shall be instituted exclusively in federal or state courts located in the United States, and you agree to submit to the personal jurisdiction of such courts.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Track Parlay regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and Track Parlay.
